There are a number of ways to have a misdemeanor charge reduced or dismissed altogether. The state of Arizona occasionally allows a misdemeanor assault case to be dismissed by completing a diversion program. This requires the defendant to complete an anger management class. Typically, this option is only available if the person in question has an otherwise clean criminal record and displays willingness to complete these classes. Aggravated assault charges have fewer – if any – leniencies.
By definition, aggravated assault indicates that a more serious crime has been committed. Aggravated assault can be defined if any of the following conditions exist:
- Serious physical injury has been caused
- A deadly weapon or dangerous instrument has been used
- Disfigurement, loss or impairment of any body organ
- Assault is committed while victim is restrained or otherwise unable to resist
- Assault occurs after entering the victim’s private residence
- If the defendant is 18 years of age or older and the victim is 15 years of age or younger
- An order of protection has been violated
Additional conditions apply if the victim in question is a member of law enforcement, a firefighter, emergency services worker, teacher, health care practitioner, or prosecutor, public defender, or judicial officer. Attempting to remove a firearm or any other kind of weapon from a peace officer can also result in an aggravated assault charge.
